This document represents a legally binding agreement between you — the User (whether a Buyer or a Seller, acting individually or through authorized representatives) — and SSS Trade Zone Private Limited (referred to as “JustBuySell”, “we”, “our”, or “us”). By accessing, using, or transacting on the JustBuySell platform, you agree to these Terms and Conditions for commercial use only.

The domain www.justbuysell.com, and the mobile applications under the brand name “JustBuySell” (collectively referred to as the “Platform”), are owned and operated by SSS Trade Zone Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN: U51909DL2010PTC203499, with its registered office at Khasra No-19/4, Kamruddin Nagar, Near Butterfly School, Najafgarh Road, Nangloi, Delhi – 110041.

By using this Platform, you acknowledge and agree that JustBuySell operates as a Business-to-Business (B2B) platform and provides services exclusively to businesses and commercial entities.

This document, referred to as the Terms & Conditions, User Agreement, or Agreement, outlines the legally binding terms between you (the “User”) and the Directors of SSS Trade Zone Private Limited (collectively referred to as “JustBuySell”, “we”, or “us”). These terms govern your access to, and use of, our website, mobile applications, and any associated services. This includes activities such as browsing offers, posting information, unlocking contact details, and interacting with other users.

By accessing or using the Platform, you confirm that you have read, understood, and unconditionally agree to abide by these Terms & Conditions. You also agree to the Privacy Policy, which is deemed an integral part of this agreement and can be accessed via the link provided [privacy policy].

Your continued use of the Platform constitutes your acceptance of all policies and terms, including future amendments. All use of the Platform and associated tools and services shall be governed by the laws of India. If you transact through the Platform, your transaction will also be subject to the relevant and applicable policies in force at that time. Your use of the Platform establishes a binding legal obligation between you and JustBuySell.

1. APPLICABILITY OF TERMS

This Terms and Conditions Agreement applies to you if you view, access, or use the JustBuySell Platform, including but not limited to browsing offers, posting or unlocking contact details, or sharing/obtaining any information or data for the purpose of buying or selling products and services.

For the purposes of this Terms of Use, the terms “You” or “User” refer to any individual or legal entity accessing or using the Platform, whether simply browsing or participating in business activity as a buyer or seller. JustBuySell may permit access to certain portions of the Platform even without user registration. The terms “We,” “Us,” or “Our” refer to JustBuySell.

By using the Platform to post buy/sell offers or access any related services (including but not limited to price discovery, product details, ratings, or reviews), you agree to abide by any additional guidelines, terms, and policies relevant to that specific activity. These additional terms shall be considered a part of and fully incorporated into this Terms of Use.

We reserve the right to modify, update, add to, or remove parts of these Terms of Use at any time, without prior notice. It is your responsibility to review the Terms periodically. Continued use of the Platform following any such changes constitutes your acceptance of those updates. As long as you comply with the Terms of Use, you are granted a limited, non-exclusive, non-transferable right to access and use the Platform.

By accessing, browsing, or otherwise using the Platform, you acknowledge and agree to all terms and conditions stated in this Terms of Use. Please read them carefully before proceeding. By explicitly or implicitly accepting the Terms of Use, you also agree to be bound by JustBuySell’s policies (“Policies”), including but not limited to the Privacy Policy, as may be updated from time to time.

2. DISCLAIMER

Use of the JustBuySell Platform is offered to You subject to your acceptance of all the terms, conditions, and notices outlined in these Terms of Use, including our Privacy Policy and other applicable policies, which are incorporated herein by reference. JustBuySell may update, amend, or modify these terms at its sole discretion and will post such updates on the Platform. Your continued use of the Platform after any such updates will constitute your acceptance of the revised terms.

The Platform is available only to persons who are legally competent to enter into binding contracts as per the Indian Contract Act, 1872. Individuals classified as “incompetent to contract,” including minors and undischarged insolvents, are not permitted to access or use the Platform. If you are below 18 years of age, you must access or use the Platform through your legal guardian in accordance with the law. JustBuySell reserves the right to terminate or restrict access to the Platform if it is found or suspected that you are under the age of 18 years or otherwise ineligible.

JustBuySell operates solely as a listing and discovery platform. It allows users to post buy or sell offers for commodities, industrial materials, and other bulk or frequently price-changing goods. These offers include indicative pricing, product details, quantity, and location. JustBuySell does not participate in any communication, negotiation, agreement, or transaction between users and does not play any role in ensuring the security, legality, or timely execution of such transactions.

By using this Platform, you understand and acknowledge that JustBuySell does not facilitate or verify any transaction between users. The platform does not collect or require any digitally signed terms of sale/purchase nor enforce any contractual obligations between buyers and sellers. All business dealings take place directly between the concerned users, at their own risk and discretion, after one party unlocks the other’s contact details by paying a nominal platform fee.

Any ratings or feedback provided by users on the Platform are based solely on their individual transaction experiences and do not represent the opinions or validations of JustBuySell. We do not guarantee the quality, accuracy, or completeness of any user-generated content, offer, or feedback listed on the Platform.

Access to certain services on the Platform may require payment of platform usage or unlocking fees. JustBuySell reserves the right to modify or introduce such fees at any time, and such changes shall become effective immediately upon being posted. Unless stated otherwise, all fees shall be quoted in Indian Rupees. You are solely responsible for ensuring compliance with all applicable local and national laws regarding such payments.

By continuing to use the Platform, registering an account, or accessing any part of the services, you confirm that you have read, understood, and agreed to be legally bound by these Terms of Use, including the Privacy Policy, and all other applicable rules, guidelines, or legal requirements under Indian law and any relevant jurisdiction.

Please review these Terms regularly. Your continued use of the Platform constitutes your consent to any updates made to the Terms.

3. ABOUT US

JustBuySell is a digital B2B (Business-to-Business) platform managed by SSS Trade Zone Private Limited, designed to simplify the process of discovering and connecting with potential buyers and sellers of commodities, industrial raw materials, and other frequently price-changing goods.

The platform enables users to post Buy or Sell offers, along with key details such as pricing, minimum order quantity (MOQ), product location etc. Interested users can browse these offers and upon finding a suitable one, choose to unlock the contact details of the user who posted the offer by paying a nominal platform fee. Once the contact details is unlocked, both parties are free to communicate directly and execute their business transaction independently, without any interference or facilitation from JustBuySell.

JustBuySell serves strictly as a listing and discovery platform. It does not participate in, mediate, or verify any negotiations, agreements, or transactions that occur between users after contact details are exchanged. The platform also does not collect or require digitally signed documents like “Terms of Sale” or “Terms of Purchase” and does not create or enforce any binding commitment between users.

To promote trust and transparency, the platform allows users who have unlocked contact details and interacted with the offer to leave a rating and review based on their business experience. This feedback system helps future users assess the credibility of sellers and buyers on the platform.

By using JustBuySell, you acknowledge that all communications, negotiations, transactions, and due diligence are to be handled independently by the users themselves. JustBuySell assumes no responsibility for the outcome, quality, delivery, payment, or fulfillment of any transaction conducted through the platform.

In essence, JustBuySell is a tool that empowers businesses to connect — offering visibility and access, while keeping control of the actual deal entirely in the hands of the users.

4. ELIGIBILITY TO USE THE PLATFORM

Use of the JustBuySell Platform is permitted only to individuals who are legally capable of entering into binding contracts under the Indian Contract Act, 1872. Persons deemed “incompetent to contract,” including but not limited to minors, undischarged insolvents, and others as defined under the Act, are not eligible to access or use the Platform.

Users who have previously been suspended or permanently removed from the JustBuySell Platform for any reason are also ineligible to use the services.

By accessing or using the Platform, you confirm and represent that:

  • You are of legal age and capacity to enter into a binding contract.
  • You are not barred from receiving services under the laws applicable in India.

Access By Minors
If you are under the age of eighteen (18), you may only use the Platform under the supervision of a legal guardian, in accordance with applicable laws.

Platform Access Rights

JustBuySell reserves the right to:

  • Terminate your membership and/or deny access to the Platform if it is discovered that you are under 18 years of age or have submitted your contact details within your offer data in violation of policy.
  • Refuse access or usage of the Platform to any new users, or revoke access to existing users at any time, without prior notice and without any obligation to provide a reason.

You acknowledge and agree that you shall not:

  • Maintain more than one active account on the Platform.
  • Sell, transfer, share, or otherwise assign your Account or login credentials to any other individual or entity.

5. USER REGISTRATION, ACCOUNT RESPONSIBILITY & DATA HANDLING

1. Account Creation & Eligibility
To access and request offers via the JustBuySell Platform, you must first register and create an account (“Account”) using a JustBuySell ID. During registration, you are required to provide accurate and complete user information, including (but not limited to) your name, email address, contact number, address, GSTIN, and other details. If any conflict arises between these Terms and Additional Terms for a specific service, the Additional Terms will prevail.

2. User Responsibilies
Creating an Account is mandatory for buying or selling on the platform. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities carried out under your Account. You agree to:
(a) Promptly notify JustBuySell of any unauthorized use or security breach of your Account, and
(b) Ensure that you properly log out after each session.

You may be held liable for any losses incurred by JustBuySell or other users resulting from failure to protect your account information or due to any unauthorized use.

3. Guest Access
Limited access to the platform may be available to unregistered users, but full features and transactional functionality require registration.

4. Account Information Accuracy
You agree that all registration details provided are true, accurate, current, and complete. Providing false or misleading information—or failing to update information—may lead to suspension or termination of your Account and restriction from future access, in addition to possible legal consequences.

5. Prohibited Account Use
You must not use another user’s account credentials to access the Platform. Doing so is strictly prohibited and may result in immediate account action.

6. Payment Authorization
By using the platform for transactions, you confirm that you are the lawful holder of the payment method used (e.g., credit/debit card or electronic payment account). JustBuySell will not be liable for any loss or inconvenience arising from misuse of your login credentials or payment information.

7. Cookies & Data Storage
JustBuySell uses temporary cookies to store non-sensitive data for technical administration, research, and user experience improvement. Authorized third parties may place or recognize unique cookies in your browser for advertising or product optimization purposes. No personally identifiable information is stored within these cookies.

 

6. USER AGREEMENT AND CONTENT USAGE TERMS

1. Platform Content Restrictions
You agree that:

  • (a) You will not copy, reproduce, download, republish, sell, distribute, or resell any part of the services or content—such as text, images, videos, files, directories, databases, or listings—available on or through the JustBuySell platform (“Platform Content”).
  • (b) You will not use, compile, or extract Platform Content to operate or support a competing business, or for any commercial exploitation, including but not limited to creating collections, compilations, databases, or directories, whether by automated means (robots, spiders, etc.) or manual processes.

2. Third-Party Links And Content
JustBuySell may provide access to third-party content, products, or services via links (e.g., text, banners, APIs). You are advised to review the terms and privacy policies of such third-party websites before engaging. JustBuySell does not control or endorse third-party platforms and is not liable for any content, products, or services accessed through them.

3. Platform Integrity And Feedback System
You agree not to engage in any activity that could damage, manipulate, or undermine the integrity of JustBuySell’s feedback or rating systems.

4. Commercial Use Only
You agree to use the platform solely for commercial purposes involving the sale or purchase of products or services for resale, distribution, or other commercial use.

5. User Content License
By posting or submitting any content (“User Content”) on the platform, you grant JustBuySell and its representatives a perpetual, worldwide, royalty-free, and sub-licensable license to use, reproduce, distribute, publish, translate, and display such content in any format or medium—now known or developed in the future—for purposes related to platform operations and services. You confirm that you hold all necessary rights and authority to grant this license.

6. Compliance With IT Rules
You confirm that you have read and understood Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and acknowledge that these regulations are binding on both you and JustBuySell in addition to this agreement.

 

7. TRANSACTION BETWEEN USERS & PLATFORM DISCLAIMER AND LIMITATION OF LIABILITY

JustBuySell is merely a facilitator and is not and cannot be a party to or control in any manner any advertisement, exhibition, quality/nature of goods on the Platform.

Users acknowledge that JustBuySell shall not be held liable for any damages, claims, or losses arising from user-generated postings on the platform. This includes, but is not limited to, the inability to fulfill buy/sell offers, the quality or authenticity of products or services offered, or any delays, inaccuracies, or issues related to transaction details or pricing, regardless of the circumstances.

JustBuySell merely provides a digital platform for users to post and view buy/sell offers. The platform is not involved in any way in the negotiations, communications, transactions, or agreements between users. As such, JustBuySell does not assume any responsibility for the outcome of any business or financial dealings that occur between users who connect through the platform.

JustBuySell is not a party to any transaction or contract formed between users and shall not be liable for any fraudulent, misleading, or unlawful activity conducted by any user, including but not limited to false listings, misrepresentations, non-delivery, or misuse of contact details obtained from the platform.

Users are solely responsible for conducting their own due diligence before entering into any communication, transaction, or agreement. We strongly recommend verifying the authenticity, credibility, and intentions of other users before proceeding with any engagement.

By using the platform, users agree to indemnify and hold JustBuySell harmless from any claims, disputes, losses, or damages that may arise out of or in connection with interactions or offers facilitated through the platform.

 

8. OFFER INFORMATION

JustBuySell strives to provide You with information on the best prices possible for the Products shown through Platform. The price shown shall be based upon the prevailing and regularly fluctuating rates of those products fixed by the buyer/seller at its sole discretion.

Further:
JustBuySell reserves the right to refuse to process offers/requisitions from/to Users with a prior history of unacceptable conduct (including without limitation breach of any agreements by Users with JustBuySell or breach of any policy).

 

9. USER OBLIGATIONS

Subject to compliance with these Terms, JustBuySell grants You a personal, non-exclusive, non-transferable, limited privilege to access and use this Platform.

You agree to use the services, Platform and the materials provided therein only for purposes that are permitted by: (a) the Terms; and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You agree to adhere to all limitations on dissemination, use and reproduction of any materials (such as the Product CATALOGs) that You access on the Platform.

You agree not to access (or attempt to access) the Platform and the materials by any means other than through the interface that is provided by JustBuySell. You shall not use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy or monitor any portion of the Platform or Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not deliberately made available through the Platform.

If Platform requires/allows You to post and upload any information/material on the Platform, You hereby undertake to ensure that such material is not offensive and in accordance with applicable laws. Further, You undertake not to:

Defame, abuse, harass, threaten or otherwise violate the legal rights of others;

Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information through any bookmark, tag or keyword;

Upload files that contain software or other material protected by applicable intellectual property laws unless You own or control the rights thereto or have received all necessary consents;

Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Platform or another’s computer;

Engage in any activity that interferes with or disrupts access to the Platform or the services (or the servers and networks which are connected to the Platform);

Attempt to gain unauthorized access to any portion or feature of the Platform, any other systems or networks connected to the Platform, to any JustBuySell server, or to any of the services offered on or through the Platform, by hacking, password mining or any other illegitimate means;

Probe, scan or test the vulnerability of the Platform or any network connected to the Platform, nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Platform, or any other customer of JustBuySell, including any JustBuySell Account not owned by You, to its source, or exploit the Platform or service or information made available or offered by or through the Platform, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Platform;

Disrupt or interfere with the security of, or otherwise cause harm to, the Platform, systems resources, accounts, passwords, servers or networks connected to or accessible through the Platform or any affiliated or linked sites; Collect or store data about other users in connection with the prohibited conduct and activities set forth. Use any device or software to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform;

Use the Platform or any material or Content for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of JustBuySell or other third parties;

Conduct or forward surveys, contests, pyramid schemes or chain letters;

Download any file posted by another user of Platform that you know, or reasonably should know, cannot be legally distributed in such manner;

Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;

Violate any code of conduct or other guidelines, which may be applicable for or to any particular facility on the Platform;

Violate any applicable laws or regulations for the time being in force within or outside India;

Violate the Terms including but not limited to any applicable Additional Terms of the Platform contained herein or elsewhere; and

Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Platform.

JustBuySell has no obligation to monitor such communications by You. However, JustBuySell reserves the right to review materials posted by You and to remove any materials in its sole discretion. JustBuySell reserves the right to terminate the User’s access to any or all of such services/facilities provided by JustBuySell at any time without notice for any reason whatsoever.

JustBuySell reserves the right at all times to disclose any information as is necessary to satisfy or comply with any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in JustBuySell’s sole discretion.

JustBuySell does not control or endorse the content, messages or information found in any communication service and, therefore, JustBuySell specifically disclaims any liability or responsibility whatsoever with regard to the communication services and any actions resulting from the user’s participation in any communication service. You agree that You are solely responsible to JustBuySell and to any third party for any breach of Your obligations under the Terms and for the consequences (including any loss or damage which JustBuySell or its affiliates or its vendors may suffer) for any such breach.

You agree that JustBuySell may, at any time, modify or discontinue all or part of the Platform, charge, modify or waive fees required to use the Platform, or offer opportunities to some or all Platform Users.

You agree that the Platform shall not be used for illegal purposes. The Information and Services shall not be used for any illegal purpose. You shall not access our networks, computers, or the Information and Services in any manner that could damage, disable, overburden, or impair them, or interfere with any other person’s use and enjoyment. You shall not attempt to gain unauthorized access to any Information or Services, other accounts, computer systems, or networks connected with the Platform, the Information, or Services. Such unauthorized access includes, but is not limited to, using another person’s login credentials to access his or her JustBuySell profile/ account. Any attempt by any individual or entity to solicit login information of any other user or to access any such account is an express and direct violation of these Terms of Use and of applicable law(s), including relevant privacy and security laws and laws prohibiting unfair or unethical business practices.

 

10. USAGE CONDUCT

You shall be solely responsible for maintaining the necessary computer equipment and Internet connections that may be required to access, use and transact on the Platform.

You are also under an obligation to use this Platform for reasonable and lawful purposes only, and shall not indulge in any activity that is not envisaged through the Platform.

You shall use the Platform, and any voucher/ coupons purchased through it, for personal, non-commercial use only and shall not resell the same to any other person.

11. INTELLECTUAL PROPERTY RIGHTS

       1. Ownership Of Platform Content
The JustBuySell platform, including its design, structure, text, graphics, user interfaces, visual interfaces, sounds, music (if any), artwork, and computer code (collectively referred to as “Content”), is owned and controlled by JustBuySell. The selection, arrangement, and presentation of this Content are protected by copyright, patent, trademark, and other intellectual property laws.

        2. Trademarks And Logos
All trademarks, logos, and service marks (“Marks”) displayed on the platform are the property of JustBuySell or relevant third parties. You are not permitted to use these Marks without prior written consent from JustBuySell or the respective owners of the Marks.

        3. Intellectual Property Ownership
Unless explicitly stated otherwise, JustBuySell retains ownership of all intellectual property rights associated with the platform, including but not limited to:

  • Copyrights, patents, and utility models
  • Trademarks and goodwill
  • Source code, meta tags, and databases
  • Text, graphics, icons, and hyperlinks
  • Trade secrets, designs, and inventions (patent pending)

         4. Restrictions On Use
Except as expressly permitted, you agree not to:

  • Copy, republish, post, display, translate, transmit, reproduce, or distribute any Content from the platform through any medium.
  • Use any proprietary material owned by JustBuySell or third parties without obtaining prior authorization.

By accessing or using the JustBuySell platform, you acknowledge and agree to comply with these intellectual property rights and restrictions. Any unauthorized use of the Content or Marks may result in legal action.

12. DISCLAIMER AND LIMITATION OF LIABILITY FOR JUSTBUYSELL PLATFORM

You expressly acknowledge and agree that, to the fullest extent permitted by applicable law:

         1. Platform And Services Provided “As-Is”
The JustBuySell platform, services, and materials are offered on an “as is” basis without any warranties, whether express, implied, statutory, or otherwise. This includes but is not limited to implied warranties of title, non-infringement, merchantability, or fitness for a specific purpose.

JustBuySell does not guarantee that:

  • The platform or services will meet your requirements or function uninterrupted, timely, secure, or error-free.
  • The results obtained from using the platform will be accurate, effective, or reliable.
  • The quality of the platform, services, or materials will meet your expectations.
  • Any errors or defects in the platform or services will be corrected.

No advice or information, whether oral or written, obtained from JustBuySell shall create any warranty unless explicitly stated in the terms.

       2. Limitation Of Liability

  • JustBuySell assumes no responsibility for user-generated content, including but not limited to issues arising under intellectual property laws, libel, privacy, publicity, or other applicable laws.
  • The company disclaims liability for any misuse, loss, modification, or unavailability of user content.
  • JustBuySell is not liable for any losses caused by unauthorized use of your account or account information, whether or not you are aware of such use.

         3. Information ccuracy
While JustBuySell strives to provide accurate and reliable information, the platform does not warrant or guarantee the quality, accuracy, or completeness of any data, information, products, or services.

         4. Service Interruptions And Risks

  • JustBuySell is not liable for delays, unavailability, or interruptions of the platform due to periodic maintenance, technical issues, or reasons beyond the company’s control.
  • Any material or data downloaded from the platform is done at your own risk, and you are solely responsible for any damage to your systems or data loss.
  • The company disclaims responsibility for invalid coupons or typographical errors.

         5. Third-Party Risks
You understand and accept the risk of potential loss or damage to your data caused by third-party actions beyond JustBuySell’s control.

         6. Product Warranty
JustBuySell warrants that products sold on the platform will reasonably match their description, quality, and nature as displayed.

By using the JustBuySell platform, you acknowledge these terms and accept all associated risks and limitations.

13. INDEMNIFICATION AND LIMITATION OF LIABILITY

You agree to indemnify, defend, and hold harmless JustBuySell, including but not limited to its affiliates, vendors, agents, and employees, from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees and disbursements, along with applicable interest) incurred or asserted against JustBuySell. This indemnification arises from any breach or non-performance of any representation, warranty, covenant, agreement, or obligation by you under these Terms.

Additionally, you agree to protect JustBuySell from any third-party claims that arise due to your use of the platform, including but not limited to:

  • Claims that your material caused harm to a third party.
  • Violations of these Terms or the rights of others, including intellectual property rights.

Limitation Of Liability:
Notwithstanding anything to the contrary, the maximum liability of JustBuySell to you or any other party under these Terms shall be limited to the refund of the amount charged for the specific sale, purchase, or service related to the claim.

Under no circumstances shall JustBuySell, its officers, partners, employees, or suppliers be liable for any special, incidental, indirect, consequential, or punitive damages, including loss of use, data, or profits. This applies whether such damages were foreseeable, advised of, or based on breach of contract, warranty, negligence, or other actions, and whether arising directly or indirectly from your use of the platform, services, or materials.

These limitations and exclusions shall apply to the fullest extent permitted by applicable law.

14. VIOLATION OF THE TERMS

JustBuySell reserves the right, at its sole discretion and without prior notice, to terminate your access to the Platform and block future access, in addition to pursuing legal actions in court, if it determines that you have violated these Terms or Additional Terms. You acknowledge that any violation of these Terms constitutes an unlawful and unfair business practice that causes irreparable harm to JustBuySell, for which monetary damages are insufficient. You agree that JustBuySell may seek injunctive or equitable relief, as deemed necessary or appropriate, in addition to any other remedies available under law or equity.

Additionally, JustBuySell may, at its sole discretion and without prior notice, terminate your access to the Platform for reasons including, but not limited to:

  1. Requests from law enforcement or government agencies,
  2. A self-initiated request by you to delete your account,
  3. Discontinuation or significant modification of the Platform or its services, or
  4. Unexpected technical issues or problems.

If JustBuySell initiates legal action against you due to your violation of these Terms, it will be entitled to recover all reasonable attorneys’ fees and related costs from you, in addition to any other relief granted.

15. TERMINATION

This agreement shall remain in effect until either the User or JustBuySell permanently terminates access to the Platform by closing the registration. However, any obligations that are intended to survive termination shall continue to remain enforceable.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms, along with all transactions conducted on or through the Platform and the relationship between You and JustBuySell, shall be governed by the laws of India, without reference to conflict of laws principles.

In the event of any dispute or difference arising between You and JustBuySell concerning the performance, interpretation, or application of these Terms, Privacy Policy, Additional Terms, or any related matter, such disputes shall be referred to sole arbitration. The Arbitrator will be appointed by JustBuySell, and their decision shall be final and binding on both Parties.

The Arbitrator will issue notices to You via registered post at the address provided during account registration, and such notice will be deemed sufficient. The costs and expenses of the arbitration proceedings shall be borne by You. The arbitration proceedings shall be conducted at a location determined by JustBuySell and will be binding on You. The arbitration will be conducted exclusively in English.

You further agree that all claims, differences, and disputes arising under or related to the Platform, these Terms, or any transactions or relationships established through the Platform shall fall under the exclusive jurisdiction of the courts in Delhi, India. By agreeing to these Terms, You accept and submit to the jurisdiction of these courts.

Users can submit grievances related to the Platform or Services, including issues regarding abuse on the Platform or concerns about the processing of information, to the designated Grievance Officer at the contact details provided below. REPORT ABUSE

If you encounter any abuse, violation of these Terms, or objectionable content on the Platform, please report it promptly to JustBuySell’s customer support team.

19. PRIVACY POLICY (IN ADDITION TO PRIVACY POLICY) 

At JustBuySell, safeguarding your privacy is a fundamental priority. We securely store and process your account information, including any sensitive personal or financial data (as defined under the Information Technology Act, 2000), on systems protected by physical and technological security measures. These measures comply with the provisions of the Information Technology Act, 2000, and the rules framed under it. If you do not agree to the transfer or use of your information in this manner, we advise you not to use the Platform.

In the event of a merger, acquisition, reorganization, amalgamation, restructuring, or any similar transaction involving JustBuySell (or its assets), some or all of your personal information may be shared, sold, transferred, licensed, or conveyed to the relevant business entity. The receiving entity, whether a new or combined organization, will be obligated to adhere to this privacy policy with respect to your personal information. By providing your information to us, you consent to its use by JustBuySell and its affiliates to deliver various services related to your transactions, whether conducted on www.justbuysell.com, with third-party merchants, or on third-party platforms.

By using the Platform, you acknowledge that you have read, understood, and agree to the Privacy Policy of JustBuySell. Furthermore, you confirm that the terms and contents of the Privacy Policy are acceptable to you.

20. GENERAL PROVISIONS

JustBuySell may serve notices or communications via email or through general notifications on the Platform. If you need to send any notice to JustBuySell under these Terms, please do so at the designated email address: (mail id).

Assignment: You are not permitted to assign or transfer these Terms, or any rights or obligations arising under them, to any third party. However, JustBuySell retains the right to transfer or assign its rights and obligations under these Terms to any third party without requiring your consent.

Severability: If any provision of these Terms is deemed unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law to reflect the original intent of the parties. All remaining provisions of these Terms shall remain valid and enforceable.

Waiver: If JustBuySell fails to enforce or exercise any provision or right under these Terms, such failure shall not be considered a waiver of that provision or right.
